These Terms of Use govern your access to and use of storageblue.com, including all content, features and services offered on or through it (collectively, the “Website”), operated by StorageBlue (“Company,” “we,” “us” or “our”). By using this Website, you accept and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use this Website.

This Website is offered and available to users who are 18 years of age or older and reside in the United States. By using this Website, you represent and warrant that you meet these requirements.

Changes to the Website and These Terms

We may revise and update these Terms of Use at our sole discretion. All changes are effective immediately when we post them. Your continued use of the Website after a revised version is posted means you accept the changes. We may also change, suspend or withdraw all or any part of the Website at any time without notice.

Rental Agreement Controls Your Storage Unit

Your storage unit is governed by the rental agreement (lease) you sign, not by these Terms of Use or by any description on this Website. If there is any conflict between the Website and your signed rental agreement, the rental agreement controls. Your rental agreement is month-to-month unless it states otherwise, and rent, fees and late charges are as set out in that agreement.

Online Rentals, Pricing and Availability

• Unit sizes, rates, promotions, discounts and availability shown on this Website come from our management system and can change at any time. A unit is not held for you until an online move-in is completed.
• Unit dimensions are approximate and are provided for comparison only. Actual size, layout, ceiling height and access may vary by unit and facility.
• Promotional offers may require a minimum stay, may apply to specific unit types or facilities, cannot be combined unless we state otherwise, and may be withdrawn at any time.
• Your first payment may be prorated based on your move-in date, and applicable New Jersey sales tax is charged on monthly rent.
• We reserve the right to correct pricing or availability errors and to cancel a rental affected by an obvious error, in which case we will promptly reverse any amount charged.

Payments and Autopay

• By submitting a payment on this Website, you authorize us to charge the payment method you provide for the amounts shown at checkout, including rent, prorated rent, applicable taxes, fees and any optional products you select.
• If you select the optional tenant protection plan, you authorize the monthly premium of $14 to be billed with your rent. Coverage, limits and exclusions are governed by the plan documents, not by this Website.
• If you enroll in autopay, you authorize recurring charges to your payment method on your monthly due date until you cancel. You may cancel autopay at any time in your tenant account or by contacting your facility.
• You are responsible for keeping your payment method and contact information current. Declined payments may result in late fees and other remedies under your rental agreement.

Free Curbside Pickup

Free curbside pickup is offered as a courtesy service subject to availability, scheduling windows, distance limits (currently up to 75 miles), and the size and nature of the items to be moved. Pickup requests are not confirmed until we confirm them with you. We may decline to move items that are unsafe, prohibited, excessively heavy, or that require disassembly, specialized equipment or additional labor. Additional terms, including any required minimum rental period and any liability waiver, are provided when the pickup is scheduled.

Tenant Accounts

To use certain features you must register for or claim a tenant account. You agree to provide accurate information, to keep your password confidential, and not to disclose it to any other person. You are responsible for all activity that occurs under your account, and you agree to notify us immediately at info@storageblue.com of any unauthorized access. We may disable any account at any time if, in our opinion, you have violated these Terms of Use.

Prohibited Uses

You may not use this Website:

• in any way that violates any applicable federal, state, local or international law or regulation;
• to transmit any advertising or promotional material without our prior written consent, including any “junk mail,” “chain letter,” “spam” or similar solicitation;
• to impersonate or attempt to impersonate the Company, an employee, another user or any other person or entity;
• to introduce any viruses, Trojan horses, worms, logic bombs or other material that is malicious or technologically harmful;
• to attempt to gain unauthorized access to, interfere with, damage or disrupt any part of the Website, the server on which it is stored, or any server, computer or database connected to it; or
• to use any robot, spider, scraper or other automatic device, process or means to access the Website for any purpose, including monitoring or copying any of the material on the Website, without our prior written consent.

Intellectual Property

The Website and its entire contents, features and functionality — including all information, text, displays, images, photographs, video, logos and design — are owned by the Company, its licensors or other providers and are protected by United States and international copyright, trademark and other intellectual property laws. The StorageBlue name and logo are trademarks of the Company. You may not reproduce, distribute, modify, publicly display or create derivative works of any material on this Website except as permitted by these Terms of Use.

Third-Party Links and Services

This Website contains links to and integrations with third-party sites and services, including our management and electronic signature platforms, payment processor, mapping and address lookup services, mobile app stores, truck rental partners and review platforms. We do not control and are not responsible for the content, policies or practices of those third parties, and your use of them is at your own risk and subject to their terms.

Disclaimer of Warranties

THE WEBSITE AND ALL CONTENT, MATERIALS AND SERVICES PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT INFORMATION SUCH AS RATES, AVAILABILITY OR HOURS WILL ALWAYS BE ACCURATE OR COMPLETE. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Limitation on Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF REVENUE, PROFITS, DATA OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THIS WEBSITE. THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, AND IT DOES NOT ALTER THE RIGHTS AND OBLIGATIONS SET OUT IN YOUR RENTAL AGREEMENT.

Indemnification

You agree to defend, indemnify and hold harmless the Company and its affiliates, licensors and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of your violation of these Terms of Use or your use of the Website.

Governing Law and Disputes

These Terms of Use and any dispute arising out of them or your use of this Website are governed by the laws of the State of New Jersey, without giving effect to any conflict of law provisions. Any legal suit, action or proceeding shall be instituted exclusively in the federal or state courts located in Passaic County, New Jersey, and you waive any objection to venue in those courts. Any cause of action must be commenced within one (1) year after it arises.
